The Professional Master`s Program in Law and Conflict Management originated from the articulation between Uniara`s consolidated experience in conflict management, as well as the integration of experiences of a highly qualified faculty, associated with the broad spectrum of demands for advanced training, brought by the Brazilian judiciary. In this context, the contributions of the Judicial Center for Conflict Resolution and Citizenship of the District of Araraquara (CEJUSC) and the Special Criminal Center (NECRIM) stand out. It is worth noting that the quality of the work that supports the Professional Master`s Program in Law has been built over more than 40 years of institutional maturity in teaching and research in Law, in Uniara`s undergraduate and lato sensu graduate courses.
CEJUSC was the first arbitration center to operate in the interior of the state of São Paulo. It has been installed at Uniara since November 2011, when the University signed an agreement with the Court of Justice of the State of São Paulo. Its importance is evident in the volume of services provided. In 2019 alone, the Center provided 1,234 services, achieving an impressive result of over 70% effectiveness in the definitive resolution of conflicts under its management.
The Special Criminal Center (NECRIM) is a project of Uniara in partnership with the Civil Police whose mission is to encourage agreements and resolve conflicts between neighbors and family members, traffic accidents with minor victims and threats or defamation. The development of these extension projects demonstrates, on the one hand, an important institutional experience in the foundations of the Master`s degree proposal and, on the other hand, the need for innovative research in the area of dejudicialization. It is also noted that the concepts of the Professional Master`s Program in Law - PMPD at Uniara are closely related to the demands of society. Both legal practitioners and citizens seek solutions and paths capable of expanding the range of judicial action, whether in terms of speed or in promoting valid, solid, and rapid extrajudicial solutions.
The adequate training of professionals working in law can be supported by a stricto sensu program, with a proposal aligned with the profile and expectations of the target audience. Uniara`s professional master`s degree in law and conflict management aims to combine theoretical and practical approaches to generate innovative legal solutions.
The basic objective of the program is to train students to expand their insertion in the job market and, at the same time, generate applied legal knowledge that can be appropriated by the legal community, through properly guided research activities, with the final course work as the main product. In addition to this, there is the teaching production itself (technical and bibliographical), informed by the professional experience acquired by the professors.
The program was designed for students who do not intend to interrupt their professional activities during the course or even after its completion, despite the possibility of becoming part-time teachers, especially in undergraduate and graduate courses.
It is also expected to build a new model of applied legal research, which brings together traditional doctrinal research with a dogmatic basis (which often ignores the factual context and remains hermetic) and pervasive empirical research (which is more guided by an approximation to reality than by methodological particularities).
The relevance of the application in the professional environment is basically evidenced by the possibility of presenting practical recommendations on legal topics that make sense to legal practitioners and public policy makers, and above all contribute to solving open problems in a creative and innovative way. The propositional component of research is considered essential for generating legal innovation.
